The other deputy and the cook went to the Osage Agency and left Marshal McWeir in charge of the prisoner, but when the deputy and cook returned they found Marshal McWeir had been shot and assaulted with an axe. The prisoner fled the scene with Marshal McWeir's revolver, but was shot and killed weeks later by the friends of two brothers he killed during a robbery.
