Description: Patrolman Smerdel was accidentally shot and killed while cleaning his department service weapon at the police substation. The Colorado Supreme Court upheld the lower court's decision affirming that Officer Smerdel suffered death as a result of an accident arising out of and in the course of his employment as a police officer.
